Terms of Service

1. Eligibility and accounts

You must be able to form a binding contract under applicable law to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to update it as needed.

We may suspend or terminate accounts that violate these Terms, pose security risks, or misuse the Services.

2. Description of the Services

Local Mama provides tools to discover local businesses, community listings, stories, notice boards, classifieds, and related features. Features may change, be added, or discontinued. We do not guarantee uninterrupted or error-free operation.

3. User content and conduct

You may submit content such as listings, descriptions, images, and posts (“User Content”). You retain ownership of your User Content, but you grant Local Mama a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, modify, display, distribute, and otherwise use User Content as reasonably necessary to operate, promote, and improve the Services.

You agree not to use the Services to:

• Violate any law or infringe others’ rights (including intellectual property and privacy).
• Post false, misleading, defamatory, harassing, hateful, or obscene material.
• Distribute malware, spam, or engage in scraping or automated access that overloads or harms the Services without permission.
• Impersonate any person or misrepresent your affiliation.
• List illegal goods or services, or content that promotes harm or discrimination.

We may remove or restrict User Content and take other actions we reasonably believe are necessary to protect users, the public, or the Services.

4. Businesses, listings, and transactions

Information about businesses and offers on Local Mama is provided by users or third parties. Local Mama is not a party to transactions between you and businesses or other users unless we explicitly state otherwise. You are responsible for verifying details, pricing, and suitability before engaging with any listing. Any dispute is between you and the relevant business or user.

5. Intellectual property

The Services, including software, design, branding, and our content (excluding User Content), are owned by Local Mama or its licensors and are protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or reverse engineer any part of the Services without our prior written consent.

6. Third-party services

The Services may link to or integrate third-party websites, maps, payment providers, or other services. Those services are governed by their own terms and privacy policies. We are not responsible for third-party content or practices.

7. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LOCAL MAMA AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) INR 1,000, IF YOU HAVE NOT HAD ANY PAYMENT OBLIGATION TO US.

9. Indemnity

You agree to indemnify and hold harmless Local Mama and its affiliates from claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Services, or your violation of these Terms or applicable law, except to the extent caused by our wilful misconduct.

10. Termination

You may stop using the Services at any time. We may suspend or terminate access to the Services for any reason, including breach of these Terms, with or without notice. Provisions that by their nature should survive (including ownership, disclaimers, limitation of liability, indemnity, and governing law) will survive termination.

11. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to mandatory consumer protections in your jurisdiction, courts located in India shall have exclusive jurisdiction over disputes arising from these Terms or the Services, unless we agree otherwise in writing.

12. Changes to these Terms

We may modify these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. Continued use after changes become effective constitutes acceptance of the revised Terms, except where applicable law requires a different process.
